Well first off you can copy right a web site design, however no one can push a copyright through that quickly. So if Oscar dose copyright it, it would be after the fact of the lawsuit being filled and thus invalid. Also unfortunately since you don’t have trademarks or copyrights, your web design is know as public domain and is available for free use.
I'm not sure where people get these ideas, but what you've stated it patently (pun intended) false.
Your web site is copyrighted as soon as you create it; much as a picture is copyrighted as soon as you take it, or a book copyrighted as soon as you write it. It falls under common law. You don't even have to slap a Copyright notice on it (but it certainly will aid your case if you do).
You can of course register your copyright, which does take some time to process, but is still fairly painless... however that simply gains you some additional protections.
The idea that your web site becomes public domain if you do not register your copyright on it is completely untrue as well.
