You might check into that non-compete. Most states won't uphold that if you are layed-off or are downsized. That is usually only there to protect the company from having you find another job while you are gainfully employed by them. I know that is the way it works in Kansas and Missouri.
 
It has happened to me, in November 5 years ago. Fortunately things have worked out, but I didn't do what was suggested and hit the ground running, so my one recommendation would be to get going quickly on a replacement postition. Good luck!

It's alright Golfanatic, I'm gearing up to be laid off in January. Be glad you are fortunate enough to have a few weeks in severance...I'm only getting 2, and I have a CAREER. Such is life. It's nasty at times, but you'll be okay there fella.

Sorry to bump this back up, but I have some great news! I have had one offer already, been on 4 interviews, and am having a pretty much guaranteed job interview with my same company next week in a different department.

Thanks for all you support, but I have some serious decisions ahead of me. Severance? Less/More money? New Company?

I did check on this and you guys are both correct. It does not apply to me being laid off. Thanks for the heads up.
