Smoking at my cigar shop now ILLEGAL

So KC had a vote today. On the ballet Question 3 which as you may have guessed from the post title is a smoking ban. So what is the big deal. Well firstly there was already a smoking ban in place in KC. Secondly this one bans smoking in cigar shops. Thirdly, and the part that pisses me off, the ballet OMITTED the part where it mentions banning smoking in a cigar store.

Seriously WTF? How can you put an initiative on the ballet an OMIT a clause? So pissed.......can't type :angry: :angry: :angry:

"QUESTION 3

Shall the city of Kansas City prohibit smoking in enclosed places of employment, enclosed public places and on public sidewalks abutting acute care hospitals, while allowing it in casino gaming areas until all casinos located in the Missouri counties of Jackson, Platte and Clay, and the Kansas counties of Johnson and Wyandotte are obligated by ordinance, statute or law to prohibit smoking within the casino areas where gambling games are allowed, as set forth in Ordinance No. 080073, for the purpose of promoting public health by decreasing citizen’s exposure to secondhand smoke and creating smoke free environments for workers and citizens through regulation in the work place and all public places?"

"Calling for submission to the voters of Kansas City, at a special election to be held Tuesday, April 8, 2008, a question amending Chapter 34, Code of Ordinances, by repealing Article XII, Smoking in public places, consisting of Sections 34-471 through 34-481 and enacting in lieu thereof a new Article XII entitled "Prohibitions on smoking in enclosed places of employment and public places and public sidewalks abutting acute care hospital property lines," consisting of Sections 34-471 through 34-481, prohibiting smoking in enclosed places of employment, enclosed public places and public sidewalks abutting acute care hospital property lines, while allowing it in casino gaming areas until surrounding casinos are covered by laws banning smoking; establishing penalties for noncompliance; authorizing and directing the City Clerk to notify the responsible election authorities of this election; and recognizing an emergency."

What an absurd thing! I am so sorry to hear it.
Sorry for you and your customers, but also sorry for us all, living in a society that has become so unhinged from reality that something like this can actually pass. :(
 
What does this mean for the Outlaw event?

Someone needs to sue. People have the right to congregate with like minded people. I support smoking bans in public places. I like smoking bans in resturants, I don't want to smell someones smoke when I'm trying to enjoy a meal. Banning smoking in establishments that cater to smokers is crazy. It should be a violation of our rights. If you don't smoke what are you doing there, and why do you care? People need to get a life.

We have a smoking ban, but tobacco stores, bars, and any resturants that want to ban anyone under 18 can have smoking. Resturants with bars have to be able to fully enclose the bar from the resturant to have smoking. It doesn't matter though most everyone that allows smoking bans cigars.

Gotta get a filter for my basement.

What irritates me about the whole thing, is that the casinos here pushed back, so they were removed from the law. If the city is going to enforce their moral authority, they need to take on everyone. Don't exempt the casinos just because they threatened to pull back their money.
 
I said three years ago that in ten years we'd be smoking in our cars, on our decks and in our garages.............and no where else.

Jeebus, what an underhanded thing to do. Isn't there some way to fight this? I know it is a legal vote but since they omitted the key part as the "where" they were voting on banning smoking from. Isn't there something that can be done? I am sorry to hear that. Like Dave stated, I'm sorry for you, your customers, and all of us. What is the world coming too? When will the anti-smoking Nazis stop? One day I will be smoking in my closet under a blanket with the lights off hoping the neighbors don't narc on me.

Some places have already banned smoking in your car. I think it applies if minor children are present.

Some places you can't smoke in an apartment if there is a unit above. You are being told you can't do something that is legal in your own residence.
 
So does this mean we won't be able to smoke at the herf next weekend? Laws like this are really frustrating, although I am pretty used to it at this point unfortunately...
 
Unbelievable...

If someone wants to run a business which allows smoking on the premisses, it should be his or her right. People who dislike smoking within the confines of a establishment also should have the right to not do business with any place which allows smoking.
simple as that, no?

No smoking at the Outlaw!? Who do I write/call/email? I will be happy to let the mayor/city counsel members of KC know that from now on, I for one, will be spending as little money as possible in that city. :angry:

BTW, is this ban within the KC city limits or include all the suburbs?
 
Welcome to the club. Time for a nonprofit smoking lounge. Thats how we did it here in Louisville.
 
Awwwww crap. That sucks green donkey d*cks. Score another for the smoking Nazis. Can't say that I'm shocked tho.

We're in the same boat here - no smoking in any public place that has employees, even the cigar shops. So the 2 shops took 2 different tactics. One boarded off their lounge, has a private entrance, hung a sign that says paying members only ($35 a year, thank you very much) and we're good. The other did a totally different thing. They no longer have employees, but co-owners! That is being challenged by the city and will be in court soon they say. Don't look too good is the rumor.

It's funny - everywhere I drive, I'm always looking at buildings that are open thinking "that one would make a GREAT private club..."

I disagree. I also don't much care for the smell of cigarette smoke while I am trying to enjoy my meal, but that doesn't mean it should be outlawed.

I believe that the owner of the restaurant should have the right to decide the smoking policy of the establishment he owns and shouldn't be forced to do what he doesn't feel is in the best interest of his business. If enough people want a non-smoking establishment, then there would be someone there to capitalize on that market. If you don't like the owner's rules complain to the owner or manager, not to the law makers.

That's insane. Sadly, it looks to be the direction. I was recently in Canada at a very nice Habanos shop with an attached lounge that was just gorgeous. It was staffed with knowledgeable and friendly smoking attendants. However, all smoking was to be outlawed in the province in three days. You could see the sadness and disappointment in their eyes.
